While Personera prohibits such conduct and content on its site, you understand and agree that Personera cannot be responsible for the content posted on its web site and you nonetheless may be exposed to such materials and that you use the Personera service at your own risk.
You have read the Facebook terms of use as published on the Facebook website and you have complied fully with them.
General conditions
We reserve the right to modify or terminate the Personera service for any reason, without notice at any time.
We reserve the right to alter these Terms of Use at any time.
We reserve the right to refuse service to anyone for any reason at any time.
The use of the Personera service is subject to us verifying to our satisfaction your identity in accordance with these Terms of Use.
We may, but have no obligation to, remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
Intellectual property rights
All the content, trademarks and data on this web site, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of or licensed to Personera and as such are protected from infringement by local and international legislation and treaties.
You shall retain all intellectual property rights arising from images and any other materials that you own and upload onto the Personera service. We shall have the right to use, copy, distribute, print and disclose to third parties any content uploaded by you and any other materials for the purpose of providing the Personera service.
Electronic communications
When a user visits Personera, signs in with the Personera service, or sends emails to Personera, that user consents to receiving communications from Personera electronically and agrees that all agreements, notices, disclosures and other communications sent by Personera satisfies any legal requirements, including but not limited, to the requirement that such communications should be “in writing”.
Products purchased
Unless otherwise required by applicable law, all payment transactions processed through the service are non-refundable and are non-reversible by purchasers through the service.
The risk of loss and title for Personera products pass to the purchaser upon our electronic transmission of the order confirmation to the product recipient. We are not responsible for lost or stolen Personera products.
Vouchers and coupons
A coupon is a voucher that can be used multiple times by more than one party.
Vouchers cannot be exchanged for cash. Vouchers must be redeemed at www.personera.com towards the purchase of products listed on the website.
Vouchers cannot be redeemed at any affiliate websites.
Only one promotional voucher can be used per transaction.
Vouchers can only be redeemed with orders already placed with Personera if their issue date is before the order date.
Promotional vouchers are issued at Personera's own discretion.
Customers do not have a right to promotional vouchers and vouchers cannot be earned.
Vouchers can only be redeemed while they are valid and expiry dates cannot be extended.
General information
Personera makes no guarantees regarding the performance of its service. Personera shall not be liable for interactions with any organizations and/or individuals found on or through the Personera service. This includes, but is not limited to, delivery of goods and services, and any other terms, conditions, warranties or representations associated with such dealings. By using our service, you agree that Personera is not responsible for any damage or loss incurred as a result of any such dealings.
Personera reserves the right to cancel any Personera products and refund all associated payments, less any processing fees, at any time and for any reason.
Personera will have the right to close customer accounts, withhold all funds, and request alternative forms of payment if a fraudulently obtained Personera product is ordered through the Personera service.
Disclaimer
Apart from the provisions of sections 43(5) and 43(6) of the Electronic Communications and Transactions Act, neither Personera nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this web site or the services or content provided from and through this web site. Furthermore, Personera makes no representations or warranties, implied or otherwise, that, amongst others, the content and technology available from this web site are free from errors or omissions or that the service will be 100% uninterrupted and error free.
This web site is supplied on an “as is” basis and has not been compiled or supplied to meet the user's individual requirements.
